Tax Deferred Exchanges
If you're looking to sell real estate that has increased in value, you may be able to defer paying capital gains taxes. Section 1031 of the internal revenue code allows owners of appreciated real estate to defer paying capital gains tax if they use the proceeds of the sale to buy another property of equal or greater value.
However, to qualify for tax deferment, the transactions must be linked meaning that you must exchange your current property for the new property. To avoid tax consequences, you'll have to appoint a third party to accept the transfer of your title to your current property, title to the new property and the proceeds of both sales.
There are exchange companies set up to manage this exchange, but handling this type of process can be complicated. We can facilitate this exchange by dealing directly with exchange companies and we can expedite the process for you.
